What Islam Says About the Use of Dagga Now That it’s Legal

Following the Constitutional Court ruling that the use and cultivation of marijuana for personal use is legal, Radio Islam’s Mufti Yusuf Moosagie says the use of cannabis is not permissible in Islam.

Dagga users, traditional healers, and Rastafarians celebrated the ruling on Tuesday decriminalising the personal consumption and cultivation of cannabis by adults in private spaces.

Mufti Moosagie says the Shariah ruling is clear about intoxicants.

“The principle of the Shariah is that any substance that causes intoxication is not permissible. The prohibition of cannabis is also on the fact that it harms one’s health. This smoking or consumption of anything in the form of cannabis or synthetic imitation cannabis due to it being an intoxicant will not be permissible.”

However Mufti Moosagie says Dagga may be used in the treatment of severe illnesses.

“There may be certain circumstance where for illness and that people do take it and there are leeway that is given in that regard.”

The ConCourt judgment also points out police still have the right to arrest those in possession of cannabis for dealing and not for personal consumption or using it in the presence of children.
