The Johannesburg High Court has ruled that the Democratic Alliance (DA) Mpho Phalatse’s removal as Joburg mayor was unlawful and invalid after removing her in a no-confidence motion. Phalatse was replaced by the African National Congress (ANC), Dada Morero.

Last week, the DA argued that the decision by Johannesburg Council Speaker Colleen Makhubele to call an extraordinary council sitting two days after she was elected last month was unlawful.

This is because the programming committee decided against an inaugural sitting.

Therefore, the court found that the ousting of Phalatse as mayor occurred during an illegal gathering and has been declared unlawful.

Phalatse has celebrated Tuesday’s court outcome, calling it a victory for democracy.

Last night the national coalition structure met regarding Johannesburg and Ekurhuleni metros, with ActionSA saying it will back the DA-led coalitions.

Meanwhile, Mayor of Ekurhuleni, Tania Campbell, will face a motion of no confidence on Wednesday after opposition parties cited a lack of service delivery.
