The Muslim Judicial Council has welcomed the decision by the Western Cape High Court to provide legal protection to Muslim women and their children in case of a divorce.
Judge Siraj Desai handed down judgment today ruling that President Cyril Ramaphosa and other respondents have failed in their constitutional obligation to have legislation enacted that governs Muslim Marriages and its consequences within the South African context.
The MJC’s says this is a milestone for Muslims as a minority in South Africa.
The MJC’s 2nd Deputy President, Shaykh Riad Fataar says the MJC awaits government to fulfil their constitutional obligation and facilitate the process to enact the legislation as soon as possible as per the court order.
“It is now the opportunity seeing that our president has also been mentioned. It is an opportunity for President Ramaphosa to make a mark in history and recognise the Muslim community in their marriages which was so long overdue.”
