Man Claims Over R 1M From Police Minister for Unlawful Arrest

A 34-year old Rustenburg man, Khaka was arrested and detained for approximately 4 months despite the absence of any charges against him and any intention to secure his prompt attendance at court is claiming more than R1.1 million from the Minister of Police Nathi Mthetwa.
 
Senior Associate – from the Commercial and Property practice of law firm Adams & Adams, Jean-Paul Rudd said Khaka is claiming inter alia past and future medical expenses, past and future loss of income / earning capacity and general damages for pain and suffering, loss of liberty, injury to dignity and loss of amenities of life.
 
Nathi Mthetwa failed to appear in court to defend the action whereafter default judgment was applied for by Rudd. Judge Baqwa of the North Gauteng High Court ruled that the Khaka is entitled to recover 100% of his proven or agreed damages from Minister Mthetwa.
 
It is alleged that during detention Khaka was continually assaulted by fellow inmates and now suffers from acute and severe post traumatic stress. He was furthermore unable to work during the period of the unlawful detention.
 
Rudd said they have applied for a trial date in February 2014. “We have furthermore secured expert professionals to quantify Khaka’s damages,” added Rudd.
