Pressure group Accountability Now says if Public Protector Busisiwe Mkhwebane is struck off the roll of advocates her entitlement as the public protector falls away.
Mkhwebane is moving from one court to the next, while fighting fires on several fronts.
The Constitutional Court on Monday dismissed Mkhwebane’s application to set aside a high court judgment, which ordered that she pay 15% of the costs in the Reserve Bank case from her own pocket.
The Con Court also rebuked Mkhwebane for being dishonest and providing falsehoods.
Accountability Now’s Advocate Paul Hoffman says the Legal Practice Council is expected to meet on Friday to discuss the implications of the findings of the Constitutional Court against Mkhwebane.
“The Public Protector Act in Section 1A sets out various categories of people who are eligible to be the public protector. Obviously if she is no longer an advocate, then the prequalification to become the public protector falls away and so does her entitlement to be the public protector.”
Hoffman says if Mkhwebane does not resign, she could be impeached, face disciplinary action from the Legal Practice Council or face perjury charges.
