[LISTEN] OUTA: “Public Protector Busisiwe Mkhwebane Doesn’t Know What She’s Doing or She Doesn’t Care”

The Organisation Undoing Tax Abuse (OUTA) says South Africa’s legal system is lambasting Public Protector Busisiwe Mkhwebane’s for the way she conducts herself in office.

Outa’s Advocate Stefanie Fick was speaking to Radio Islam about the Constitutional Court’s judgment that President Cyril Ramaphosa never wilfully mislead Parliament or personally benefitted from the donations made to the CR17 campaign for the ANC presidency.

Justice Chris Jafta handed down the judgment on Thursday morning.

The apex court also found that Mkhwebane, had no authority to investigate the matter in the way that she did.

Fick says several judgments by the courts have not gone in Mkhwebane’s favour.

“It’s not as if he courts are saying ‘you know what you made a little mistake we don’t necessarily agree with you here is a better judgement.’ They are lambasting her for the way she investigates. So, it really, really highlights the question, is she competent to be the public protector of South Africa, a Chapter Nine institution?”

Fick says the CourtCourt judgement also raised concerns about her competency.

“She either doesn’t know what she’s doing or she doesn’t care and I do not know which one is worse. At this point in time, I think what this ConCourt judgment tells us or is asking the question why is Advocate Mkhwebane really not seriously thinking about removing herself from this division.”

Fick says unless there is other evidence of alleged money laundering emerges against Ramaphosa, the  Apex court judgement basically settles the matter against him.
