[LISTEN] Liberty Fighters Network Takes Legal Action Against Government & Lockdown Level 4 Regulations

The Liberty Fighters Network (LFN)says while the government is aware that a court order granted by the high court in June last year declaring all disaster management acts and lockdown regulations as unconstitutional and invalid, they are continuing to enforce the lockdown measures in the country.

The organisation is up in arms after President Cyril Ramaphosa put the country back under Adjusted Level 4 measures from the past Sunday.

Liberty Fighters Network says it also received a very pathetic letter from Cooperative Governance and Traditional Affairs Minister Nkosazana Dlamini-Zuma, in which she told the LFT to proceed with their contempt of court proceedings against her.

Speaking to Radio Islam, the LFN’s Reyno de Beer says when it comes to the constitutional invalidity of the regulations, only the court that granted the order can suspend it.

De Beer says the country is in a constitutional crisis.

“The government knows that that order came into operation on the 24th of June last year already. Since then, they have been continuously enforcing these null and void regulations. They kept on amending to it even though they know that the only way in which they could do it was to create a total new set of regulations. They totally just defied the court.”

De Beer says they will be proceeding with the contempt of court charges against Dlamini-Zuma.

“We are in the process of compiling and finalising the necessary court application. We hope that it will be issued still this week else it will be definitely done over the weekend.”

De Beer says they have a good success rate against unlawful arrests and prosecutions for violations of the lockdown regulations and disaster management act.

“So we are telling people, especially our places of faith, places of worship, we do have a very good success rate in churches who have utilized the 2nd of June court order. When the police came to arrest them and they showed the court, the police could not proceed to arrest the people and so they continued with their worshiping services as normal with the social distancing and with the mask and everything .”

De Beer says people should know about their rights and the implications of the 2 June court order and how it protects them.
