Fresh from failing to bring the country to a standstill, Julius Malema sustained another setback on Thursday morning as the ConCourt ruled that the EFF won’t succeed on land invasions interdict. This is a significant legal defeat for the party. The ConCourt upheld an interdict preventing the party and its leader from encouraging citizens to invade unoccupied land. AfriForum acquired the interdict in 2017 after Malema had, between 2014 and 2016, encouraged landless South Africans to occupy private lands unlawfully.
The Constitutional Court today dismissed Julius Malema and the EFF’s application for leave to appeal against an interdict which AfriForum acquired in 2017, which prohibited Malema and the EFF from inciting people to trespass on private property and to occupy it illegally. In January 2023, Malema and the EFF applied for leave to appeal this case at the High Court in Pretoria. The High Court dismissed their application, prompting the EFF to approach the Constitutional Court with this matter.
“The implications of Malema and the EFF’s intense desperation to have this land invasion judgment overturned, are troubling. Why is the EFF so determined to be able to incite lawlessness?” says Ernst van Zyl, Campaign Officer for Strategy and Content at AfriForum.
This ruling is, however, yet another major win for the right to private property and a devastating loss for those who wish to incite criminality and violence. AfriForum welcomes the Constitutional Court’s reaffirming of the High Court’s strong judgment against the incitement of land invasions, Van Zyl concludes.
