The Muslims Lawyers Association (MLA) has lodged a complaint for the arrest of Indian Prime Minister Narendra Modi when his visits South Africa for the BRICS Summit which takes place from 25 to 27 July.
Dubbed the Modi docket, it calls for the National Directorate of Public Prosecutions (NDPP) to investigate Modi and bring him to trial for his alleged involvement in war crimes and gross human right violations in Indian occupied Kashmir.
The MLA contends there is sufficient evidence to establish a case against Modi for the alleged extra-judicial murders, rape and other human right violation in Indian occupied Kashmir.
The MLA’s Yousha Tayob says their complaint was raised in terms of the International Customary Law and/or the Rome Statute to which South Africa is a signatory
Tayob says the NDPP, Hawks and government authorities have acknowledged receipt of the complaint on 29 June.
“It’s not just a warrant of arrest. It’s a request to open a docket, conduct an investigation and if they believe than an arrest and prosecution is necessary based on the evidence that we provided to them, that they commence with the entire process.”
Tayob says the MLA will also be lodging complaints against Chinese President Xi Jinping and Russian President Vladimir Putin.
