The Johannesburg High Court has rejected Ace Magashule’s challenge to his suspension as secretary general of the African National Congress (ANC).
Judges Jody Kollapen, Sharise Weiner and Edwin Molahleli delivered the unanimous judgement on Friday.
Magashule was suspended in May after he failed to abide by the ANC’s National Executive Committee’S (NEC) step-aside resolution.
The resolution states that party members charged with corruption or other serious crimes should step aside within 30 days or face suspension.
Delivering the judgement, judge Jody Kollapen says the ANC’s step-aside resolution does not constitute discrimination and the party’s constitution is consistent with South Africa’s constitution.
“The application incorporating the relief sought is dismissed with costs including the costs of three counsel. The judgment is handed down.”
Magashule faces charges over a contract to audit homes with asbestos roofs, between 2014 and 2016, when he was premier of the Free State.
