President Cyril Ramaphosa has filed papers in Gauteng High Court for an urgent application to interdict former President Jacob Zuma from taking further steps to give effect to his private prosecution bid against the President.

To analyse the case, Radio Islam International speaks to a Political Analyst from North-West University, Professor Andre Duvenhage.

The step-aside rule within the ANC reads after prosecution in some way should the step-aside rule apply.

According to Prof Duvenhage, certain conditions need to be met in a private prosecution and clarification from the national prosecution authority that the case is cleared.

“The Ramaphosa camp is arguing that this position is not clear and Zuma is misusing the court to obstruct forms of justice,” he says.

In this case, references have been made to Advocate Billy Downer and Karien Morgan. Prof Duvenhage said the role of Karien includes receiving information from Billy Downer regarding Zuma’s health, which Karien communicated in public.

“This makes her part of the bigger problem situation,” he added.

There were several court cases on this matter, including several appeals, which were all unsuccessful.

Meanwhile, regarding the merit and substance of the case, Prof Duvenhage says Zuma is clear and would like to remove Advocate Billy Downer as he is the guy who knows all the content of the case against Jacob Zuma.

“It is clear that Ramaphosa is going to act stronger on the findings of commissions and individuals after his re-election as President of the ANC, which is a huge concern to people like Jacob Zuma,” he said.
