The Democratic Alliance (DA) says it has obtained legal advice following a move by the African National Congress (ANC) to issue a notice to convene a special council meeting to elect a new Speaker in the City of Johannesburg.

In a recent letter to new Johannesburg Mayor Geoff Makhubo, Cooperative Governance and Traditional Affairs (COGTA) MEC Lebogang Maile, instructed the city council to convene urgently to elect a new Speaker and instructed it that City Manager, Ndivhoniswani Lukhwareni should preside over the meeting.

Johannesburg Council Speaker Vasco Da Gama of the DA currently occupies this position, as a motion of no confidence the ANC recently brought against him failed.

Speaking to Radio Islam, the DA’s Caucus leader in the City of Johannesburg, Funzela Ngobeni says the decision by the ANC is unlawful, as the position of the speaker is not vacant.

“They cannot just be using their Cogta representatives who are ANC members to then act illegally and instruct the city manager to convene illegal meetings in the city. That cannot be allowed to happen and we will challenge that with the might that we have.”

Ngobeni adds they still do not know which DA members voted against the party for the ANC’s Makhubo to be elected as Mayor of Joburg saying the incident has been escalated to national level.
