The SA Health Products Regulatory Authority (Sahpra) says while the Constitutional Court decriminalized the use, possession and cultivation of Cannabis for private use, it did not rule that it could be sold to the public.

With cannabis-related products popping up in shops and at stalls at shows held around the country, the South African police and Sapra have issued a warning against the illegal manufacture of cannabis products.

In 2018, the Constitutional Court ruled that the private use of cannabis was permitted.

Sahpra’s Momeena Omarjee says growing and producing cannabis products and pushing them onto the public is not only illegal, but it is not safe.

“If you are making medical indications of therapeutic indications or medicinal claims to the products, they have to be registered with Sahpra. They have to be evaluated for the quality, safety and efficacy of those products. If not, they are illegal.”

Omarjee says there are cannabis products that are safe to use.

“There are cannabis containing products that are available globally, currently we don’t have any registered in South Arica. But there is a mechanism and a provision within the medicines act that allows for access to those products by an authorized practitioner for a specific patient.”

Police say they would act not only against businesses that sell cannabis illegally, but also against the customers who buy these products.
