The Wits Law Clinic says it has received a number of cases surrounding the matters related to fraudulent marriages in South Africa.
After fighting against the Home Affairs Department for more than a decade to escape bogus marriages, the Wits Law Clinic says it has taken up the cases of five women who are now getting the legal support they need and laying the groundwork for a class-action lawsuit.
The organization has revealed how victims have been pushed from pillar to post at various stages of their own efforts to have the fake marriages nullified.
Speaking to Radio Islam, Wits Law Clinic’s Phillipa Kruger says while trying to assist the women, they have had very little cooperation from home affairs.
“We are going to take the matter, unless it’s resolved by the department of course, we are taking them to court to ask the court to order that the records be corrected and that our clients be given proper identity documents.”
Kruger says she asked for a meeting with senior Home Affairs officials to obtain a proper understanding of the policies and procedures to set aside fraudulent marriages, however the letter went unanswered.
