Labour Court Rules Elana Barkhuizen Suspension Unlawful

The Labour Court has found the suspension of a Schweizer-Reneke teacher was unlawful and ordered that her suspension be lifted with immediate effect.

Elana Barkhuizen is the teacher who took the picture that went viral this month showing black and white pupils seated at separate tables in a Grade R classroom.

No action has yet been taken against her colleague who was in charge of that class.

Trade union Solidarity approached the court on an urgent basis seeking the suspension against the North West primary school teacher be lifted.

Solidarity’s Dirk Herman has welcomed the ruling, but says they are disappointed they had to go to court to fight Barkhuizen’s suspension.

“We see this judgment as a victory for justice in general. Of course it’s a victory for Elana Barkhuizen, but this is much more than that.”

An emotional Barkhuizen says she’s happy justice has been served.

“Thank you to everybody for all the support, everyone who helped, everyone who was there for me.”

Judge Connie Prinsloo has ordered Laerskool Schweizer-Reneke and the governing body to ensure that Barkhuizen is back in the classroom tomorrow
