The National Prosecuting Authority says while there is inadequate and no direct evidence to arrest Indian Prime Minister Narendra Modi it will continue to investigate him for his alleged involvement in war crimes and human rights violations in Kashmir.
The Muslim Lawyers Association (MLA) lodged a complaint with the NPA calling on authorities to arrest Modi when he attends the Brics Summit later this month in Johannesburg.
In a letter to the association, the NPA says In order to arrest Modi it must not only be proved that the crimes in question were committed but that the requirements of command responsibility in respect of him have been satisfied.
The MLA’s Yousha Tayob says they are not deterred by the NPA’s decision and continue to hope that Modi will be held accountable for his alleged involvement in war crimes and crimes against humanity.
“They’ve decided not to arrest and or prosecute Modi at this stage. So what we will do is gather the evidence they’re looking for, but we’re very satisfied with the extent and the PCLU must be commended for their efforts in regards to looking at this docket on an urgent basis and that the fact there’s an ongoing investigation gives us a lot of hope.”
