ConCourt Rules Parliament Failed to Hold Zuma Accountable

The Constitutional Court has found Parliament has failed to hold President Jacob Zuma accountable after the Nkandla ruling, which found that he failed to uphold and respect the Constitution.

The judgment was handed down by Justice Chris Jafta in the Constitutional Court on Friday. 

Jafta ruled the court made the finding while ruling on whether Parliament should initiate impeachment proceedings against President Jacob Zuma. 

He says there were four judgments‚ but one majority judgment would be binding.

“The Chief Justice characterizes the majority judgment as a text book case of judicial overreach, a constitutionally impermissible intrusion by the judiciary into the exclusive domain of Parliament.”

Jafta also ruled the National Assembly must comply with the section 237 of the constitution – President Jacob Zuma and The National Assembly must pay costs of the application jointly including costs to counsel. 

Meanwhile the African National Congress (ANC) says it has noted the judgment of the Constitutional Court and that it will study the judgment and  discuss its full implications when the National Executive Committee (NEC) meets on the 10th January 2018.
