Judge Billy Mothle has found that anti-apartheid activist Ahmed Timol did not commit suicide and died as a result of being pushed from the 10th floor of the John Vorster police station which amounts to murder.
Judgment was handed down in a packed North Gauteng High Court in Pretoria today.
Judge Billy Mothle says that from the day Timol was arrested until he died, he was assaulted and tortured by the security branch.
He ruled that former police officer Joao Rodrigues was an “accessory to murder”, committed perjury and should be investigated.
“Timol did not jump out of the window of room 1026 but was either pushed out of the window or from the roof of the John Vorster Police Station. Thus he did not commit suicide but was murdered.”
Police claimed Timol jumped to his death from the 10th floor of the 13 storey John Vorster Square 46 years ago.
While the inquest in 1972 found Timol had killed himself, new evidence suggest he was murdered by the security branch.
The inquest into Timol’s death was reopened after the family found new evidence that proved that Timol did not commit suicide, but instead died in police custody in October 1971.
